How does GDPR affect Brazil?

Before we start talking about how GDPR can affect our business, we should understand what exactly this acronym means: General Data Privacy Regulation (GDPR), basically it is a project that began to be envisioned in 2012 and approved in 2016 that aims to protect the data and identity of the citizens of the European Union.

But if I have a national company, how can this affect me?

The economic and cultural integration between countries is known as globalisation and this process is becoming increasingly clear to us because of our experience with social media and selling products online. 

Because of this, thinking that something that happens abroad will not directly affect your company sounds a little too naive. 

According to Bauman (1999), "We are responsible for the other, whether we are aware of it or not, whether we wish it or not, whether we cheer positively or go against it, for the simple reason that, in our globalised world, everything we do (or fail to do) impacts on everyone else's life and everything people do (or deprive themselves of doing) ends up affecting our lives."

The EU considers data protection a citizen's right, so even if your products and or services are not part of the bloc, they must adapt to the GDPR to be sold to the inhabitants of those places. Some of the company's obligations are: 

The service should allow the user to choose how their data will be handled and to authorise its use or not;

The user has the right to know what data is being collected and for what purposes;

The user can also access, request copy or migrate data collected to other services (where applicable)[...]

What happens if the company does not follow GDPR legislation?

The company could receive simple notification in cases of lighter infringements up to a fine of 4% of the company's annual revenue. Google, for example, was fined €50 million in France for breaching the GDPR.

Because of this, compliance is more important than ever, as it is necessary to pay attention to the compliance with this law and, above all, to understand if your company fits into these parameters and if your products and services are adequate to the legislation of the European Union.
